These general terms govern membership and use of the fit+ gym in Santa Margarida de Montbui. In the event of any discrepancy, the terms set out in the signed membership agreement prevail, and the Spanish version of this page is the binding one.
1. Parties and subject matter
The operator of the centre and contracting party is FITNESS MONTBUI, SOCIEDAD LIMITADA (single-member company), Spanish tax ID B88933023, registered at Carretera de Valls, 71 – Baixos, 08710 Santa Margarida de Montbui (Barcelona). Contact: info@fitnessmontbui.com.
The centre operates under the fit+ brand as a franchisee. The brand belongs to its owner; your membership contract is with FITNESS MONTBUI, SOCIEDAD LIMITADA only.
2. Acceptance
Applying for membership implies full acceptance of these terms and of the centre's internal rules, which are displayed at reception and available on request.
3. Minimum age
Access is not permitted to anyone under 18. The centre may ask for proof of age and identity at any time.
4. How membership is formed
You can apply at the centre or through the available forms. Submitting the form is an application, not a contract. The contract is formed when FITNESS MONTBUI, SOCIEDAD LIMITADA accepts the application and confirms it by email together with your access details.
You can review and correct all the information entered before submitting. With the confirmation we send the contract text, these terms, the withdrawal information and a withdrawal form.
5. Options, term and renewal
The contract renews automatically for the length of the option chosen unless cancellation is notified within the period below:

6. Price, joining fee and compulsory services
Current fees are those published on the pricing page, VAT included:

The joining fee and compulsory services are paid once, on joining, and are not refunded except under the withdrawal clause.
7. Payment and non-payment
Fees are paid monthly by credit card. You must keep the payment method active, valid and funded, and report any change to your payment, address or email details without delay.
If a payment fails, we will contact you so the situation can be resolved. Access may be suspended while a payment is outstanding, without interrupting the accrual of the fee or the length of the contract. Return charges attributable to the member may be passed on as provided in the agreement.
8. Right of withdrawal
Where the contract is concluded at a distance or off premises, you have 14 calendar days from the date of the contract to withdraw without giving a reason and without penalty, under the Spanish consumer protection act (TRLGDCU).
To exercise it, write to info@fitnessmontbui.com or use the form at the end of these terms. Refunds are made within 14 days of receiving the notice, using the same payment method.
If you expressly asked to start using the centre within the withdrawal period, you must pay for the proportion of the service actually provided up to the date of notice.
9. Cancellation
Cancellation is notified in writing to info@fitnessmontbui.com or by any other means that leaves a record, respecting the notice periods in clause 5. No cancellation step will be more onerous than the one required to join. We confirm receipt and the effective cancellation date.
Any temporary freeze must be requested in writing and applies only in the cases and on the conditions set out in the membership agreement.
10. Personal access
Each member receives a personal access credential to be used on every visit. It is personal and non-transferable and may not be lent, shared or transferred.
Fraudulent use of personal access may result in a €800 penalty and, where appropriate, termination of the contract.
Loss, theft or damage must be reported immediately; until then the member is responsible for its use. Replacement may carry a cost, notified beforehand.
11. Guests
Bringing another person requires prior registration and express authorisation from the centre. The member is responsible for their guest's conduct.
12. Opening hours and closures
Opening hours are 6:00 to 23:00, 365 days a year. The centre may change them with prior notice at the premises and on the website.
Full or partial closures may occur for building work, maintenance, breakdown, force majeure or by order of the competent authority. Where a closure attributable to the centre is significantly prolonged, members will be informed of the applicable compensation.
13. Rules of use
- Wear clean indoor-only sports footwear.
- Use a towel on benches and machines, and wipe equipment after each use.
- Return plates, dumbbells and accessories to their place.
- Do not block walkways or emergency exits.
- Share machines when the gym is busy.
- No food, glass containers or alcohol.
- No smoking or vaping anywhere in the centre.
- No animals, except assistance dogs.
- Follow staff instructions and safety signage at all times.
14. Changing rooms and lockers
Lockers are for use during your session only and must be emptied when you leave. The centre may open and clear lockers left occupied at closing time and place the contents in lost property.
Do not leave valuables. The centre is not liable for loss, theft or damage to personal belongings except where the law establishes such liability.
15. Right of admission and termination for breach
The centre may refuse access or terminate the contract, after notifying the member, in the event of serious or repeated breach of these terms or the internal rules, conduct endangering people or the premises, or unresolved non-payment.
16. Member's health
On joining, the member declares being physically fit to exercise. If you have a medical condition, are under treatment or have any doubt, consult a healthcare professional before starting.
Stop the activity and tell staff if you feel pain, dizziness, breathing difficulty or any worrying symptom. The centre does not provide healthcare services or individualised training prescription unless expressly contracted with a qualified professional.
17. Liability
FITNESS MONTBUI, SOCIEDAD LIMITADA is liable for damage attributable to it under applicable law and holds the public liability insurance required by current regulations. It is not liable for damage arising from improper use of the equipment, breach of the internal rules or staff instructions, or from a member concealing a relevant health condition.
18. Images and CCTV
Filming or photographing inside the centre without authorisation is not permitted, particularly where other people appear. Using a member's image for promotional purposes requires their prior, specific and revocable consent.
If the centre operates CCTV, it will be duly signposted and the processing detailed in the data protection policy.
19. Data protection
Processing of members' personal data is governed by the data protection policy, which forms an integral part of these terms.
20. Changes to these terms
FITNESS MONTBUI, SOCIEDAD LIMITADA may amend these terms or the fees with sufficient prior notice. If a change is to the member's detriment, the member may terminate without penalty before it takes effect.
21. Communications
Communications to the member are sent to the email address given on joining. Communications to the centre go to info@fitnessmontbui.com or are handed in at reception. Members are responsible for keeping their contact details up to date.
22. Severability
If any clause is found ineffective, the rest of the contract remains valid. The ineffective clause will be replaced by a legally permissible one that comes as close as possible to the intended purpose.
23. Governing law and complaints
Spanish law applies. Official complaint forms are available at the centre. For online contracts, the EU online dispute resolution platform is available at ec.europa.eu/consumers/odr.
